SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

3-406.

(A)  (1) IN THIS SECTION THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED.

(2)   "ELIGIBLE EQUIPMENT" MEANS INFORMATION PROCESSING
EQUIPMENT THAT:

(I)   IS OWNED BY THE STATE;

(II)   IS USED BY A UNIT; AND

(III)  HAS BEEN DESIGNATED BY THE SECRETARY AS
ELIGIBLE UNDER THIS SECTION.

(3)   "FUND" MEANS THE INFORMATION PROCESSING EQUIPMENT
REPLACEMENT FUND.

(4)   "UNIT" MEANS A UNIT OF THE EXECUTIVE BRANCH OF
STATE GOVERNMENT THAT POSSESSES OR ADMINISTERS ELIGIBLE
EQUIPMENT.

(B)  (1) THE SECRETARY SHALL DESIGNATE WHICH INFORMATION
PROCESSING EQUIPMENT IS ELIGIBLE EQUIPMENT SUBJECT TO THE
REQUIREMENTS OF THIS SECTION.

(2) IN DESIGNATING ELIGIBLE EQUIPMENT, THE SECRETARY
SHALL CONSIDER:

(I)  THE COST OF THE EQUIPMENT;

(II)  THE EXPECTED. USEFUL LIFE OF THE EQUIPMENT;
