WILLIAM DONALD SCHAEFER, Governor Ch. 674
As used in this subtitle:

(a)   "Emergency management [and civil defense]" means the
preparation for and carrying out of all emergency functions other
than functions for which military forces are primarily
responsible, to save lives and to minimize and repair injury and
damage resulting from emergencies beyond the capability of local
authorities.

(b)   "Local organization for emergency management [and civil
defense]" means an organization created in accordance with the
provisions of this subtitle by city, town, county, or other local
authority as authorized by the Governor under the State plan.

(c)   "Political subdivision" means any county, municipal
corporation, town, village or district.

(d)   "Emergency" means the threat or occurrence of an enemy
attack or any hurricane, tornado, storm, flood, high water,
wind-driven water, tidal wave, earthquake, landslide, mudslide,
snowstorm, drought, fire, explosion, act of terrorism or other
catastrophe in any part of the State which requires State
emergency assistance to supplement local efforts in order to save
lives and protect public health and safety.

(a)  There is a [State] MARYLAND Emergency Management [and
Civil Defense] Agency. The [Secretary of Public Safety and
Correctional Services] ADJUTANT GENERAL shall, with the approval
of the Governor, appoint a Director of [State] THE MARYLAND
Emergency Management [and Civil Defense] Agency who shall be the
executive head of the Agency. The [State] MARYLAND Emergency
Management [and Civil Defense] Agency shall be part of the
[Department of Public Safety and Correctional Services] MILITARY
DEPARTMENT. The Director shall hold office during the pleasure of
the [Secretary] ADJUTANT GENERAL, and shall receive such salary
as is provided in the budget.

(b)  Subject to the authority of the [Secretary of Public
Safety and Correctional Services] ADJUTANT GENERAL, the Director
may employ professional, technical, clerical, stenographic, and
other personnel within the appropriations and (except as to the
position of Director) subject to the conditions and limitations
contained in Article 64A of the Annotated Code of Maryland [(1957
Edition, as amended from time to time)], and the Director may
make such expenditures within the appropriations, or from other
funds made available to him for purposes of emergency management,
as may be necessary, to carry out the purposes of this subtitle.

(c)  The Director is responsible to the Governor and the
[Secretary of Public Safety and Correctional Services] ADJUTANT
GENERAL for carrying out the State emergency management program.
