represent to or lead anyone by any manner, means, practice, or
device to believe that any other person sponsors or endorses the
solicitation of contributions, or sale of goods or services for
charitable purposes, or approves of the charitable purposes or
the charitable organization if the other person has not given
consent to the use of his or her name for these purposes. Any
member of the board of directors or trustees of a charitable
organization and any other person who has agreed either to serve
or to participate in any voluntary capacity in the campaign shall
be deemed thereby to have given his consent to the use of his or
her name in the campaign.
(d) A person may not:
(1) [make] MAKE any representation that a
contribution is being requested for or on behalf of a charitable
organization or use or display any NAME, SYMBOL, emblem, device,
SERVICE MARK, or printed matter belonging to or associated with a
charitable organization for the purpose of soliciting or inducing
contributions from the public without first being authorized to
do so by the charitable organization; OR
(2) KNOWINGLY USE IN THE COURSE OF SOLICITING
CONTRIBUTIONS FOR OR ON BEHALF OF A CHARITABLE ORGANIZATION A
NAME, SYMBOL, EMBLEM, DEVICE, SERVICE MARK, OR PRINTED MATTER SO
CLOSELY RELATED OR SIMILAR TO THAT USED BY ANOTHER ESTABLISHED
CHARITABLE ORGANIZATION THAT THE USE WOULD TEND TO CONFUSE OR
MISLEAD THE PUBLIC.
(e) A professional solicitor or solicitor may not solicit
in the name of or on behalf of any charitable organization
without:
(1) Written authorization of two officers of the
charitable organization, a copy of which is filed with the
Secretary of State. The written authorization shall bear the
signature of the professional solicitor and shall expressly state
on its face the period for which it is valid; and
(2) A copy of the authorization and exhibits it and
personal identification on request to persons solicited.
(F) (1) IN CONNECTION WITH A CHARITABLE SOLICITATION OR
WITH ANY REQUIREMENT UNDER THIS SUBTITLE, A PERSON MAY NOT ENGAGE
IN A FRAUDULENT OR AN ILLEGAL ACT OR PRACTICE.
(2) THE TERM "FRAUD" OR "FRAUDULENT" INCLUDES THE USE
OF ANY DEVICE, SCHEME, OR ARTIFICE TO DEFRAUD, OR ANY DECEPTION,
MISREPRESENTATION, CONCEALMENT, SUPPRESSION, FALSE PRETENSE,
FALSE PROMISE, OR UNCONSCIONABLE CONTRACTUAL PROVISION.
