In subsection (f)(3) of this section, the reference to
a $10 reinstatement fee, which is to be paid in
addition to the $100 renewal fee under subsection (c)
of this section, is substituted for the former
reference to a $110 fee, for clarity.
The third sentence of former Art. 56, § 519(b), which
allowed suspension for a failure to renew a license
within the 30-day grace period, is deleted as
inconsistent with former Art. 56, § 519(a), which
provided that licenses expire "on January 31 of each
odd-numbered year". This section is revised to
resolve the apparent conflict in the former law, by
stating that a license expires automatically at the
end of the current license term. This revision is
consistent with the provisions of other titles of this
article and conforms to the practice of the Board.

8-309. REINSTATEMENT OF EXPIRED LICENSES.
THE BOARD MAY REINSTATE THE LICENSE OF AN INDIVIDUAL WHO,
FOR ANY REASON, HAS FAILED TO RENEW THE LICENSE BY THE END OF THE
30-DAY GRACE PERIOD, IF THE INDIVIDUAL:
(1) MEETS THE RENEWAL REQUIREMENTS OF § 8-308 OF THIS
SUBTITLE; AND
(2) PAYS TO THE BOARD A REINSTATEMENT FEE OF $120.
REVISOR'S NOTE: Item (1) of this section is new language
substituted for the fifth sentence of former Art. 56,
§ 519(b), which precluded requiring an individual "to
submit to any examination as a condition of renewal".
Since the referenced § 8-308 of this subtitle does not
include any requirement for reexamination, the intent
of the former sentence is preserved. On the other
hand, the substituted language does require compliance
with the continuing education requirements, in
accordance with former Art. 56, § 520, which imposed
the continuing education requirement on each applicant
for renewal "[n]otwithstanding § 519 of this
subtitle".
Item (2) of this section is new language derived
without substantive change from the fourth sentence of
former Art. 56, § 519(b).
