property or interest if the disclaimant had died, intestate,
DOMICILED IN THE STATE OF MARYLAND, owning the property or
interest, immediately before the effective date of the instrument
or contract.
SECTION 2. AND BE IT FURTHER ENACTED, That § 9-204(a)(l) of
the Estates and Trusts Article, as amended by this Act, shall
apply to property or an interest in the property devolving from a
deceased owner or deceased donee of a power of appointment whose
death occurs on or after the effective date of this Act.
SECTION 3. AND BE IT FURTHER ENACTED, That § 9-204(b)(1) of
the Estates and Trusts Article, as amended by this Act, shall
apply to an instrument or contract executed on or after the
effective date of this Act.
SECTION 4. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1989.

AN ACT concerning
Chesapeake Bay Critical Areas - Cutting or Clearing
Trees ---Equitable Remedies
FOR the purpose of providing certain remedies in equity for
violation of certain critical area protection program
criteria controlling the cutting or clearing of trees in
certain areas of the Chesapeake Bay Critical Areas;
authorizing a local jurisdiction to bring certain actions
under this Act; requiring the chairman of the Chesapeake Bay
Critical Area Commission to refer certain cases to the
Attorney General; expanding the authority of the Attorney
General to seek certain equitable relief; providing for the
scope and application of this Act; requiring authorizing
certain persons to prepare, oversee, and approve certain
plans to replant trees in certain areas of the Chesapeake
Bay Critical Areas; providing for the content, submission,
and approval of plans to replant trees under this Act; and
generally relating to the equitable remedies provided for
the cutting or clearing of trees in violation of certain
laws and regulations for the Chesapeake Bay Critical Areas.
