SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1989.

(House Bill 160)

AN ACT concerning

Crime and Punishment - Part-Time Employment

FOR the purpose of clarifying certain provisions of law that
exclude part-time employees from designating and choosing a
workday as a day of rest or Sabbath; defining part-time
employee; clarifying that this Act does not apply to rights
granted under a collective bargaining agreement; and
generally relating to part-time employees working on a day
of rest or Sabbath.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 27 - Crimes and Punishments

493.

(a) (1) In this section the following terms have the
meanings indicated.

(2) "Managerial employee" means any employee who is
not covered by a collective bargaining agreement and:

(i) Whose primary duties consist of the
management of the enterprise in which that person is employed or
of a customarily recognized department or subdivision of that
enterprise;

(ii) Who customarily and regularly directs the
work of 2 or more other employees in the enterprise, department,
or subdivision of that enterprise;
