8-206. REGULATIONS.

IN ADDITION TO ANY POWERS SET FORTH ELSEWHERE, THE BOARD MAY
ADOPT REGULATIONS TO CARRY OUT THIS TITLE.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 56, §
524(9).

The introductory phrase of this section, "[i]n
addition to any powers set forth elsewhere", is added
to clarify that this power is not exhaustive.

The word "may" is substituted for the former words
"which are necessary", since the Board makes at least
the initial determination as to necessity. However,
the Secretary has general supervisory responsibility
over the exercise of powers, § 8-210 of this subtitle,
but particularly over rulemaking. See Art. 41, §§
1-202 and 8-104(b) of the Code.

The former limitation "not inconsistent with the laws
of this State" is deleted as surplusage.

8-207. EQUIPMENT AND FACILITIES.

(A)  CALIBRATION OF AUDIOMETRIC EQUIPMENT.

THE BOARD SHALL REQUIRE, BY REGULATION, PERIODIC CALIBRATION
OF AUDIOMETRIC EQUIPMENT USED BY PERSONS WHO FIT HEARING AIDS.

(B)   INSPECTIONS OF FACILITIES.

THE BOARD SHALL INSPECT PERIODICALLY THE FACILITIES USED BY
PERSONS WHO FIT HEARING AIDS.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 56, §
524(10).

In subsection (a) of this section, the phrase "by

regulation" is added to conform to SG § 10-101(e). As

to the rulemaking power of the Board, see § 8-206 of
this subtitle.

Also in subsection (a) of this section, the word
"calibration" is substituted for the former word
"inspection" to state more clearly what the Board must
