SECTION 5. AND BE IT FURTHER ENACTED, That Section 2 and
Section 3 of this Act shall take effect July 1, 1989.

AN ACT concerning
Motor Vehicle Insurance - Uninsured Motorist and
Liability Coverage —Waiver
FOR the purpose of prohibiting a policy of motor vehicle
insurance from providing motor vehicle liability insurance
coverage in an amount that exceeds the amount of uninsured
motorist coverage provided under the policy unless the
insured has made an affirmative written waiver of the
difference in benefits between the two types of coverages;
providing that an individual must be notified in writing of
the right to receive a certain amount of insured motorist
coverage before making a written waiver; specifying the
requirements of the waiver form; prohibiting an insurer from
refusing to underwrite an individual because the individual
refused to make a waiver in accordance with this Act;
providing for certain penalties; making technical changes;
and generally relating to the waiver of certain uninsured
motorist requiring an insurer to offer, in writing, a policy
of uninsured motorist insurance coverage up to a certain
amount that does not exceed the amount of motor vehicle
liability coverage provided under the policy; and generally
relating to certain coverage in motor vehicle insurance
policies.
