Ch. 540

LAWS OF MARYLAND

(a)   In this title the following words have the meanings
indicated.

(b)   ["Department"] "DIRECTOR" means the [Department]
DIRECTOR of [State] THE OFFICE OF Planning.

(c)   ["Secretary"] "PLANNING" means the [Secretary] OFFICE
of [State] Planning.

[(d) "Total project funding" means the funding for the
planning, design, construction, and equipment of a capital
project through a single appropriation or authorization.]

Subtitle 2. Organization of [Department] OFFICE and
General Authority of [Secretary] DIRECTOR

5-201.

There is [a Department] AN OFFICE of [State] Planning,
established as a [principal department] PART OF THE EXECUTIVE
DEPARTMENT of the SEPARATE UNIT OF State government.

5-202.

(a)  The head of the [Department] OFFICE is the [Secretary]
DIRECTOR of [State] Planning, who shall be appointed by the
Governor with the advice and consent of the Senate.

(b)  The [Secretary] DIRECTOR must have:

(1)  training or experience in State, regional, or
local planning; or

(2)  significant civic, governmental, or business
experience in matters connected with urban or rural planning.

(c)  Before taking office, the appointee shall take the oath
required by Article I, § 9 of the Maryland Constitution.

(d)  (1) The [Secretary] DIRECTOR serves at the pleasure of
the Governor and is responsible directly to the Governor. The
[Secretary] DIRECTOR shall advise the Governor of all matters
assigned to the [Department] OFFICE and is responsible for
carrying out the Governor's policies on those matters.

(2) The [Secretary] DIRECTOR is responsible for the
operation of the [Department] OFFICE and shall establish
guidelines and procedures to promote the orderly and efficient
administration of the [Department] OFFICE. The [Secretary]
DIRECTOR may establish, reorganize, or abolish areas of
responsibility in the [Department] OFFICE as necessary to fulfill
the duties assigned to the [Secretary] DIRECTOR.
