(8)  Conforms with any coastal zone management program
developed by the State of Maryland pursuant to the federal
Coastal Zone Management Act of 1972;

(9)  Would have no material adverse effect upon
critical areas identified and designated pursuant to § 5-611 of
the State Finance and Procurement Article and Article 66B, §
3.05;

(10)  Would not impose, directly or indirectly, a
substantial burden on existing State, regional, or county public
facilities beyond their respective capacities, or that new public
facilities, if necessary, either:

(i) Would not be completed in time to serve the
facility; or

(ii) Would be inadequate to serve the facility
without causing overloading of the public facilities; and

(11)  Evidences fewer undesirable environmental,
economic, fiscal, and cultural consequences in its specific or
general proposed location than other specific or general
locations.

(b) A request for judicial review may be made only by an
aggrieved party, by a properly designated official of the county
government where the proposed facility is to be located, or by
the [State] OFFICE OF Planning [Department] pursuant to § 5-611
of the State Finance and Procurement Article.

6-602.

(a) Before the Board of Public Works may solicit bids for
or award any lease for production of oil or natural gas from
beneath lands or waters of the State, and after receiving the
written recommendation of the Chesapeake Bay Critical Area
Commission (if the leased area is located in the State's critical
areas) and the advisory comments of the Secretaries of BUDGET AND
FISCAL PLANNING, Natural Resources, [State Planning,] the
Environment, and Economic and Employment Development AND THE
DIRECTOR OF PLANNING, the Board of Public Works shall direct the
Secretary of Natural Resources in consultation with the
Secretaries of the Environment, Economic and Employment
Development, and [State] BUDGET AND FISCAL Planning AND THE
DIRECTOR OF PLANNING to prepare a statement of environmental,
fiscal, and economic impact of the proposed lease.
