WILLIAM DONALD SCHAEFER, Governor Ch. 540

[Secretary] DIRECTOR of the [Department] OFFICE of [State]
Planning and the Secretary shall serve as advisers to the
committee. The committee shall meet at least annually to review
and update the apportionment formula. In determining the
allocation formula, the committee shall take into account for
each subdivision (1) current population, (2) projected
population, and (3) other factors it deems desirable. In
determining the apportionment for any year the committee may
consider under-utilization of available funds and transfer or
advance unused allocations that have not been utilized within a
given period. The committee may reallocate funds, subject
however to the policy that over the ten year period any
subdivision shall be allocated in the aggregate the funds it
would have been entitled to receive if able to utilize them.
Before adopting an apportionment formula and before allocating
funds for any year, the committee shall notify the governing
bodies of every affected subdivision of its intended action and,
after reasonable notice, afford an opportunity for hearings on
the apportionment or allocation.

(a) Each year the Department, in consultation with the
[Department] OFFICE of [State] Planning, shall prepare a list of
recommended State projects for funding under this program for the
next fiscal year. Prior to submitting the list to the Department
of Budget and Fiscal Planning for inclusion in the budget, the
legislators from the district within which the Department is
proposing a State acquisition project shall be given an
opportunity to review the project. The list shall be submitted
to the General Assembly in a manner similar to other capital
projects as provided in [§§ 5-309 and 5-701 through 5-707]
SUBTITLE 6, TITLE 3 of the State Finance and Procurement Article.

5-905.

(a)  The local governing body shall submit every project
request for acquisition or development under this program to the
Department for report and evaluation of the benefits to be
achieved by the grant. Any municipal corporation may apply by
submitting local project applications through its local governing
body to the Department. The Department shall review the proposed
project and shall request the [Department] OFFICE of [State]
Planning to review and comment on it. If the Department approves
the project and it falls within the limits imposed by the formula
developed by the apportionment committee for the allocation of
the annual appropriation, the project will be presented, along
with reviews from appropriate agencies to the Board of Public
Works for commitment of funds.

(b)  On the first of April each year, the participating
local governing body shall submit an annual program to the
Department and the [Department] OFFICE of [State] Planning. Upon
