Ch. 540

(vi) One member shall be an elected official
from a local governing body.

(3) (i) Each member of the Commission other than the
Attorney General, Secretary of General Services, and Secretary of
[State] BUDGET AND FISCAL Planning shall serve a term of office
which is 3 years, except that, of the initial members, three
shall be appointed for a term of 1 year, three shall be appointed
for a term of 2 years, and two shall be appointed for a term of 3
years.

(ii) An ex officio member of the Commission may
elect to serve personally at any Commission meeting or may
designate a member of his or her department to represent and to
act for the ex officio member at any meeting to the same effect
as if the ex officio member were personally present.

(b) The Board consists of 9 voting members as follows:

(1) The [Secretary] DIRECTOR of [State] THE OFFICE OF
Planning, who shall be chairperson of the Board;

(f) The Departments of Health and Mental Hygiene, [State
Planning, and] Human Resources, AND THE OFFICE OF PLANNING shall
provide the Board with the necessary staff and support services.

13-106.

(a) The New Marsh Wholesale Produce Market Authority, as
the same was created by Chapter 662 of the Laws of Maryland of
1955 and amended by Chapter 845 of the Laws of Maryland of 1957,
shall transfer to the Authority all of the land, buildings,
structures, facilities, equipment and other property acquired by
the New Marsh Produce Authority pursuant to the provisions of
said Chapter 662 and Chapter 845; and upon such transfer the
Authority shall assume and be charged with all of the duties,
obligations and liabilities, whether publicly or privately owned
or operated, occupying such Produce Market Authority, including
the lease with the Mayor and City Council of Baltimore for the
land now being used for an abandoned motor vehicle facility, and
the New Marsh Wholesale Produce Market Authority shall cease to
exist. Immediately following the completion of such transfer the
Authority shall make or cause to be made an investigation and
determination as to the feasibility and economics of expanding
the operations and facilities of the New Marsh Wholesale Produce
Market at its present location so as to accommodate additional
wholesale produce merchants, including those who are presently or
who have in the past operated their businesses in other areas of
the City of Baltimore; provided, however, that prior to
undertaking any expansion of the operations and facilities of the
New Marsh Wholesale Produce Market at its present location for
