Preamble

WHEREAS, The Maryland Environmental Noise Act of 1974
(Chapter 287 of the Acts of 1974) establishes the policy of this
State with respect to the protection of its citizens from the
consequences of unacceptable levels of environmental noise
generally; and

WHEREAS, The aviation portion of the 1974 Act in particular
mandates the resolution of existing noise problems and the
prevention of new noise problems in areas near airports through
adoption of noise abatement plans and the establishment and
enforcement of noise zone regulations; and

WHEREAS, In furtherance of this established legislative
policy the General Assembly of Maryland did enact Chapter 545 of
the Acts of 1987, directing the State Aviation Administration, in
cooperation with the Board of Airport Zoning Appeals established
by Subtitle 5 of the Transportation Article, to strengthen zoning
permit procedures to further protect the general public health,
safety, and welfare of persons residing near Baltimore/Washington
International Airport; and

WHEREAS, The strengthening of zoning permit procedures
requires affirmative action by the General Assembly of Maryland
to amend Title 5, Subtitle 8 of the Transportation Article; now,
therefore,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
