SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Natural Resources

7-5A-05.

(a)  A person may not continue or commence operation of any
deep mine as an operator after January 1, 1977 without first
obtaining a permit from the Secretary.

(b)  The application for a permit shall be on a form
prescribed by the Secretary and shall be accompanied by a $200
fee. As part of the application, the operator shall include: (1)
two copies of an accurate map or plan as required by subsection
[(h)] (I) of this section; (2) a detailed mine opening sealing
plan and general reclamation plan for the affected area; (3) any
other information required by the Secretary; and (4) an
application for each other permit required for the operation by
the Natural Resources Article.

(c)  (1) [(i)] Upon submission of the completed applications
required by subsection (b) of this section, the [Secretary]
DEPARTMENT shall [issue public notice] REQUIRE THE APPLICANT TO
PUBLISH AN APPROVED PUBLIC NOTICE of the opportunity to submit
written comments and to request a hearing.

(2) THE PUBLIC NOTICE SHALL:

(I) BE PUBLISHED IN A NEWSPAPER OF GENERAL
CIRCULATION IN THE COUNTY OF THE PROPOSED MINING SITE AT LEAST
ONCE A WEEK FOR 4 SUCCESSIVE WEEKS;

(II) IDENTIFY THE OWNERSHIP OF THE LAND
THE PROPOSED PERMIT AREA;

WITHIN

(III) DESCRIBE THE LOCATION OF THE PROPOSED
OPERATION SUFFICIENTLY SO THAT IT CAN BE EASILY LOCATED BY LOCAL
RESIDENTS;
