CHAPTER 481

(Senate Bill 118)

AN ACT concerning

Deep Mining of Coal

FOR the purpose of repealing the requirement that the Secretary
of Natural Resources seek the recommendations of the Land

Reclamation Committee for certain reclamation plans;

authorizing the Department to require the applicant for a
deep mining permit to publish certain notice; providing for
an opportunity to submit written comments and request a
public hearing; authorizing the Department to provide for
protection against subsidence for certain lands, structures,
features, buildings, and dwellings requiring the Department
to adopt regulations to protect against, prevent, or correct
material damage due to subsidence; requiring a deep mine
operator to replace certain water supplies; authorizing the
Department to require the replacement of certain water
supplies adversely impacted by deep mining operations;
authorizing the Department to use funds from the Deep Mining
Fund to replace certain water supplies subject to certain
reimbursement requirements on the land owner and operator;
authorizing the use of funds from the Deep Mining Fund to
replace certain water supplies after release of all bonds on
a permit, or where funds received from forfeiture of bonds
on a permit are not sufficient; authorizing the Department
to recover certain amounts from the operator or to reimburse
the operator for certain eligible costs; authorizing the
Department to extend the liability on bonds to ensure not
release bonds unless a certain operation is in compliance
with the subtitle, rules and regulations, and permit
conditions; authorizing the Department to deposit funds
received from forfeiture of bonds in the Deep Mining Fund
and to use those funds for certain purposes; repealing the
requirement to conduct annual inspection on completed or
abandoned mine sites; providing that certain existing
regulations may be determined to satisfy a certain
requirement of this Act; and generally relating to the
permitting, regulation, and reclamation requirements for
deep mining of coal.
