WILLIAM DONALD SCHAEFER, Governor Ch. 367

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 48A - Insurance Code

27.

(3) Subpoenas of witnesses shall be served [by the sheriff]
in the same manner as if issued from a circuit court. If any
individual fails to obey a subpoena lawfully served, the
Commissioner shall forthwith report such disobedience, together
with a copy of the subpoena and proof of service thereof, to the
circuit court for the county in which the individual was required
to appear, and such court shall forthwith cause such individual
to be produced and shall impose penalties as though he had
disobeyed a subpoena issued out of such court.

175.

An original application for a certificate may be refused
until the Commissioner is satisfied under the provisions of §§
35-39 that the applicant is not guilty of violating any
provisions of this section. A certificate duly issued may be
suspended or revoked or the renewal thereof refused by the
Commissioner if he finds, after notice and hearing in accordance
with the provisions of §§ 35-39, that the applicant for, or
holder of such certificate:

(2) Has intentionally misrepresented or concealed any
material [act] FACT in the application for such certificate; or

Individual applicants for qualification to act as agents for
life insurance, health insurance or annuities, nonprofit health
service plans, dental plan organizations, and health maintenance
organizations are required to comply with the requirements of
this section.

(1) Except as provided in paragraphs [(4) and (5)]
(4), (5), (6), AND (7) of this section, each applicant is
required to submit to a personal written examination to determine
his competence with respect to life insurance, health insurance
or annuities, or subdivisions of them, including contracts for
nonprofit health service plans which may include vision plans,
dental plan organizations, and health maintenance organizations,
and his familiarity with the pertinent provisions of the laws of
this State, and shall pass the examination to the satisfaction of
the Commissioner.

(4) A person who is employed by a health maintenance
organization solely to solicit membership in the health
maintenance organization pursuant to a contract between the
