[(a)] (D) A [person] RAILROAD COMPANY may not have a common
drinking cup or a common towel available for use [in a public
place, including a passenger train or boat that carries
passengers] ON RAILROAD PROPERTY.
[(b) The Secretary may adopt reasonable rules and
regulations to carry out this section.
(c) A person who violates any provision of this section or
rule or regulation adopted under it is guilty of a misdemeanor
and on conviction is subject to a fine not exceeding $25.]
[24-203] 103.
(a) This section does not apply to a railroad locomotive
that is used only for yard-switching service.
(b) The [Secretary] COMMISSIONER may adopt rules and
regulations that regulate the sanitary condition of railroad
locomotives.
(c) Before adopting any rule or regulation under this
section, the [Department] DIVISION shall announce and hold a
public hearing on the subject.
(D) THE REGULATIONS, AT A MINIMUM, SHALL REQUIRE:
(1) TOILETS TO BE PROVIDED AND MAINTAINED IN A CLEAN
AND OPERATING CONDITION WHEN THE LOCOMOTIVE IS INITIALLY
DISPATCHED FROM ANY READY OR SERVICE TRACK;
(2) TOILET PAPER TO BE PROVIDED IN A SUITABLE HOLDER
WHICH WILL PROTECT IT FROM SOIL BEFORE USE;
(3) HAND CLEANING FACILITIES, EITHER SOAP AND WATER
AND A SUITABLE RECEPTACLE OR A WATERLESS CLEANSER, TO BE
AVAILABLE;
(4) PAPER TOWELS OR OTHER ACCEPTABLE MEANS TO BE
PROVIDED FOR DRYING THE HANDS;
(5) FRESH DRINKING WATER FROM AN APPROVED SOURCE TO
BE PROVIDED AT THE BEGINNING OF EACH RUN;
(6) BOTTLES OR JUGS FOR DRINKING WATER TO BE
THOROUGHLY CLEANSED AND SANITIZED;
(7) THE BOTTLES OR JUGS, WHEN FILLED, TO BE PROTECTED
AND HANDLED BY EMPLOYEES IN A MANNER DESIGNED TO PREVENT
CONTAMINATION;
(8) A WATER DISPENSER TO BE PROVIDED AND MAINTAINED
IN A CLEAN, OPERATING CONDITION;
