Service Commission] COMMISSIONER to show that the proposed
construction complies with the requirements relating to distance
from and height over a railroad track.

[38A.] 101.
(a) In order to provide employees a reasonably safe place to
work, it shall be the duty of all [persons, firms or corporations
engaged in the operation of railroads in this State] RAILROAD
COMPANIES to keep and maintain [those] margins alongside
[their] yard tracks AND SIDE TRACKS (except designated
cleanout and repair tracks) where [such] railroad employees are
required to walk frequently in the course of their duties,
reasonably free from debris and vegetation which unreasonably
affects the safety of such employees while working. This
section shall be enforced by the [Commission] COMMISSIONER upon
complaint and after due hearing; violations to be punishable by a
fine of not less than one hundred dollars ($100.00) nor more than
five hundred dollars ($500.00). Each day of noncompliance with
any order issued by the [Commission] COMMISSIONER under the
provisions of this section shall be regarded as a separate
violation.
(b) If the [Commission] COMMISSIONER or [its] THE
COMMISSIONER'S authorized [agent] REPRESENTATIVE finds any
condition in or on a yard track OR SIDE TRACK or in the walkway
that constitutes an immediate danger to the health or safety of
the public or any railroad employee, that yard track OR SIDE
TRACK may be immediately closed until the situation is corrected.

[(b)] (C) If the [Commission] COMMISSIONER or [its] THE
COMMISSIONER'S authorized [agent] REPRESENTATIVE finds any
condition in a sidetrack or switch [provided for in this section]
that constitutes a danger to the health or safety of any railroad
employee, the sidetrack or switch connection may be immediately
closed until the situation is corrected.

[460A.] 102.
(a) (1) Railroads in Maryland [shall provide] MAY NOT
TRANSPORT EMPLOYEES TO OR FROM WORK ON A CABOOSE OR LOCOMOTIVE
UNLESS THE RAILROAD PROVIDES a fixed seat with a back support for
[all] THOSE employees [who are transported to or from work, on a
caboose or locomotive].
