SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 78 - Public Service Commission Law
38.
[(a)] Upon the application of any shipper, every railroad
company shall construct, maintain and operate on reasonable terms
a switch connection or connections with a lateral line of
railroad or private sidetrack owned by such shipper, or provide
upon its own property a sidetrack and switch connection for such
shipper, whenever the switch connection or the sidetrack and
switch connection are safe to install, reasonably practicable and
justified by the volume of business therefor. Installation,
maintenance, and compensation shall be subject to regulation by
the Commission. Such connections may be discontinued if the
Commission finds that the above conditions justifying them have
ceased.
Article - Health - General

The Secretary may adopt rules and regulations that relate to
sanitation on railroad property as it affects the health of
railroad employees, including clerical employees, enginemen,
express employees, freight house employees, highway crossing
watchmen, maintenance of way employees, platform employees,
trainmen, and yardmen.]
Article 89 - Division of Labor and Industry
84.
(a) The Commissioner of Labor and Industry shall:
(2) Promulgate, as necessary, appropriate standards,
rules, and regulations relating to:
(I) [all] ALL areas of railroad safety and
health; AND
(II) SANITATION ON RAILROAD PROPERTY AS IT
AFFECTS THE HEALTH OF RAILROAD EMPLOYEES, INCLUDING CLERICAL
EMPLOYEES, ENGINEMEN, EXPRESS EMPLOYEES, FREIGHT HOUSE EMPLOYEES,
HIGHWAY CROSSING WATCHMEN, MAINTENANCE OF WAY EMPLOYEES, PLATFORM
EMPLOYEES, TRAINMEN, AND YARDMEN.
