WILLIAM DONALD SCHAEFER, Governor Ch. 358

(C) IN ADDITION TO THE NOTICE REQUIRED UNDER SUBSECTION (B)
OF THIS SECTION, AN APPLICANT FOR A PERMIT FOR A RUBBLE FILL
LANDFILL SHALL GIVE NOTICE OF THE APPLICATION AND HEARING:

(1)  BY CERTIFIED MAIL TO THE MEMBERS OF THE SENATE OF
MARYLAND AND HOUSE OF DELEGATES WHO REPRESENT THE LEGISLATIVE
DISTRICT IN WHICH THE RUBBLE FILL LANDFILL IS TO BE LOCATED;

(2)  BY CERTIFIED MAIL TO THE OWNERS OF REAL PROPERTY
THAT ADJOINS THE PROPOSED SITE OF THE RUBBLE FILL LANDFILL; AND

(3)  BY POSTING A NOTICE OF THE APPLICATION AND
HEARING IN A CONSPICUOUS PLACE ON THE PROPOSED SITE OF THE RUBBLE
FILL LANDFILL.

[(c)] (D) The local officials notified under subsection
(b)(2) of this section shall give notice of the application and
the hearing to all interested agencies of their respective
jurisdictions.

[(d)] (E) The public notice shall:

(1)  State that there is an application for a landfill
system or incinerator for public use to burn solid waste pending
before the Department; and

(2)  Give the date, time, and place that the
Department sets for the hearing.

[(e)] (F) At the hearing, the applicant and any other
interested person may offer evidence and present arguments for or
against the application.

[(f)] (G) To the extent practicable, the Department and
other units of the State government shall consolidate hearings
concerning permits for the same landfill system or incinerator
for public use.

9-210.

(A)  The Secretary may not issue a permit to install,
materially alter, or materially extend a refuse disposal system
regulated under § 9-204(a) of this subtitle until the Department
has a written statement from the applicant that the refuse
disposal system conforms to the county solid waste management
plan and meets all applicable zoning and land use requirements.

(B)  (1) THE SECRETARY MAY NOT ISSUE A PERMIT FOR A RUBBLE
LANDFILL UNDER § 9-204(A) OF THIS SUBTITLE UNLESS THE COUNTY IN
WHICH THE RUBBLE LANDFILL IS LOCATED HAS SPECIFIED THE TYPES OF
WASTE THAT MAY BE DISPOSED OF IN THAT RUBBLE LANDFILL IN ITS
COUNTY SOLID WASTE MANAGEMENT PLAN UNDER SUBTITLE 5 OF THIS
TITLE.
