(Senate Bill 602)

AN ACT concerning

Garrett County - Acquisition of Land by the Department
of Natural Resources

FOR the purpose of repealing amending certain limitations on the
amount of land that may be acquired by the Department of
Natural Resources in Garrett County; and generally relating
to the acquisition of land in Garrett County.

BY repealing and reenacting, with amendments,

Section 4-401, 5-207(a), and 10-801

Preamble

WHEREAS, The General Assembly finds and declares that there
has been a long legislative history of measures that have placed
or attempted to place limits or caps on the amount of land that
the Department of Natural Resources owns in Garrett County; and

WHEREAS, The measures passed by the General Assembly and
signed into law by the Governor are:

(1)  Chapter 679 of the Acts of the General Assembly
of 1983, which placed the first limitations on the use of funds
under Program Open Space to acquire land in Garrett County;

(2)  Chapter 734 of the Acts of the General Assembly
of 1984, which tried to upgrade the State's oversight of the
Youghiogheny River;

(3)  Chapter 847 of the Acts of the General Assembly
of 1986, which placed limits on the use of funds under the
Heritage Conservation Fund and other sources to acquire certain
additional lands in Garrett County after June 30, 1986;

(4)  Chapter 848 of the Acts of the General Assembly
of 1986, which placed limits on the use of any funds to acquire
certain additional lands in Garrett County after June 30, 1986;
and

(5)  Chapter 50 of the Acts of the General Assembly of
1987, which stated the circumstances under which the Department
could acquire land in Garrett County; and
