SECTION 4 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1989.

AN ACT concerning
Controlled Dangerous Substances Distribution on or Near
School Property - Penalties
FOR the purpose of increasing the minimum sentence required for a
person convicted as a subsequent offender of certain
controlled dangerous substance offenses that occur on or
within a certain distance of elementary or secondary school
property or a school bus; prohibiting the suspension of a
sentence imposed under this Act and permitting parole only
under certain circumstances prohibiting the violation of
certain controlled dangerous substance offenses on or within
a certain distances of school property or on a school bus;
providing certain penalties; prohibiting a certain defense
to a prosecution under this Act; providing a certain
affirmative defense to a prosecution under this Act;
establishing a procedure to determine the boundaries of
school property; requiring the State Board of Education to
adopt regulations requiring the posting of certain signs;
and generally relating to prison sentences of controlled
dangerous substance offenses that occur on or near school
property.
