(House Bill 888)

AN ACT concerning

Prince George's County - Sale or Display of Produce and

Merchandise on State Highways - Prohibition

PG 405-89

FOR the purpose of prohibiting a person from selling or
displaying produce or merchandise on a State highway in
Prince George's County in a manner that constitutes a
traffic hazard; requiring a person, on the order of a police
officer, to cease any activity on a highway that constitutes
a traffic hazard in violation of a certain provision of law;
clarifying language; and generally relating to a prohibition
against selling or displaying produce or merchandise on
State highways in Prince George's County.

BY repealing and reenacting, with amendments,

Section 21-1113

Annotated Code of Maryland

(1987 Replacement Volume and 1988 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Transportation

21-1113.

(a) A person may not place any structure, building, or
vehicle on a highway to sell or display any produce or
merchandise if it constitutes a traffic hazard.

(B) IN PRINCE GEORGE'S COUNTY, A PERSON MAY NOT SELL OR
DISPLAY ANY PRODUCE OR MERCHANDISE ON STATE HIGHWAYS IN A MANNER
THAT CONSTITUTES A TRAFFIC HAZARD.

[(b)] (C) On the order of any police officer, the person
shall [remove]:

(1)  REMOVE the structure, building, or vehicle
described under subsection (a) of this section; OR

(2)  CEASE ANY ACTIVITY PROHIBITED UNDER THIS SECTION.
