the power of the Board extends beyond merely setting
the hours. See, e.g., § 5-205 of this title.

In subsections (c)(3)(ii) and (d)(2)(ii) of this
section, the word "registered" is added to modify
"apprentice" since an apprentice must be registered by
the Board. See § 5-401(b) of this title.

In subsection (c)(3)(ii) of this section, the
reference to the "holder of a limited license to
provide esthetic services" is added to conform to the
practice of the Board.

In subsection (d)(2)(ii) of this section, the
reference to a "licensed cosmetologist" is added to
clarify that, in practice, the Board also allows the
more extensively trained licensee to supervise an
apprentice.

In subsection (e)(3)(ii) of this section, the
reference to a "registered apprentice" is substituted
for the former, erroneous reference to a "wig
stylist". Similarly, the phrase "under the
supervision of a licensed cosmetologist or a holder of
a limited license to provide wig styling services" is
added to conform to the practice of the Board. Absent
this substitution or addition, it would seem that an
unlicensed individual, in effect, could provide wig
styling services with no supervision.

The introductory exception in subsection (f) of this
section, "[e]xcept for an applicant for a limited
license to provide demonstrating services", is added
to reflect that, while former Art. 56, § 481 provided
generally that a person shall pass an examination "as
to fitness ... to be a demonstrator", former Art. 56,
§ 482(b), which listed specific qualifications for
demonstrators, did not include a requirement for an
examination. In practice, the Board does not require
an applicant for a demonstrator license to pass an
examination.

The Business Occupations Article Review Committee
notes, for consideration by the General Assembly,
that, unlike § 5-304 of this subtitle, this section
does not provide for credit to be given for education
in a cosmetology school outside of the State.
