SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 2B - Alcoholic Beverages
52C.
[(b) In Queen Anne's County:
(1) Except as provided in paragraph (2) of this
subsection, the board of license commissioners may not approve
any license to sell alcoholic beverages within 500 feet of a
secondary or elementary school, church, or other places of
worship, public library, or youth center sponsored or conducted
by any governmental agency. Measurement of the required distance
shall be made from the nearest point of the building of the
proposed establishment for which the license is required to the
nearest point of the property line of the school, church, or
other place of worship, public library, or youth center.
(2) Within the corporate limits of the Town of
Centreville, the distance requirement for a beer, wine, and
liquor license, Class B (on sale), and Class B (on sale, special
Sunday) - hotels and restaurants, shall be 250 feet from any
secondary or elementary school, church or other place of worship,
public library, or youth center sponsored or conducted by any
governmental agency.]
(B) (1) IN QUEEN ANNE'S COUNTY, THE DISTANCE RESTRICTION
REQUIREMENT BETWEEN AN ESTABLISHMENT PROPOSED FOR LICENSURE AND A
SECONDARY OR ELEMENTARY SCHOOL, CHURCH OR OTHER PLACE OF WORSHIP,
PUBLIC LIBRARY, OR A YOUTH CENTER THAT IS SPONSORED OR CONDUCTED
BY ANY GOVERNMENTAL AGENCY SHALL BE:
(I) 500 FEET; OR
(II) FOR A CLASS B (ON-SALE) HOTEL AND
RESTAURANT BEER, WINE AND LIQUOR LICENSE, 250 FEET.
(2) ANY DISTANCE RESTRICTION REQUIRED UNDER PARAGRAPH
(1) OF THIS SUBSECTION SHALL BE MEASURED FROM THE NEAREST POINT
OF THE BUILDING OF THE ESTABLISHMENT FOR WHICH A LICENSE IS
PROPOSED TO THE NEAREST POINT OF THE PROPERTY LINE OF THE SCHOOL,
PLACE OF WORSHIP, LIBRARY, OR YOUTH CENTER.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1989.
