used by a county volunteer fire company as described in this
subsection.

(b)   In order to be eligible to receive funds provided for
in this section, each company shall be approved, incorporated,
and recognized by the Frederick County Volunteer Fire and Rescue
Association, Inc., and meet the other standards as provided for
herein.

(c)  The board may contribute money to compensate out of
county fire, rescue, or ambulance companies rendering service in
the county in the board's sole discretion. [Incorporated
municipalities with primary responsibility for governmental
funding for fire, rescue, or ambulance services shall within
their jurisdiction hold those enumerated powers assigned to the
board of county commissioners as stated in sections 2-8-1 and
2-8-2 of this chapter.]

2-8-6.

(A) (1) IN THIS SECTION THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED.

(2)   "FIRE AND RESCUE SERVICES" MEANS FIREFIGHTING,
RESCUE, OR AMBULANCE SERVICES.

(3)   "MINIMUM RESPONSE CRITERIA" MEANS THE STANDARDS
ESTABLISHED BY ORDINANCE WHICH DESIGNATE THE BOARD OF COUNTY
COMMISSIONERS ESTABLISHES DESIGNATING THE MINIMUM REQUIREMENTS
FOR A FIRE AND RESCUE SERVICE, INCLUDING THE MAXIMUM TIME ALLOWED
TO COMPLETE AN EMERGENCY RESPONSE.

(4)   "SPECIAL TAXING DISTRICT" MEANS AN AREA SUBJECT
TO AN ADDITIONAL COUNTY PROPERTY TAX FOR THE PURPOSE OF PROVIDING
FIRE AND RESCUE SERVICES WITHIN THE DISTRICT WHICH COMPLY WITH
THE MINIMUM RESPONSE CRITERIA.

(B) THE BOARD OF COUNTY COMMISSIONERS SHALL:

(1) ESTABLISH A DEPARTMENT OF FIRE AND RESCUE

SERVICES TO PROVIDE FIRE AND RESCUE SERVICES WITHIN THE COUNTY
AND THE INCORPORATED MUNICIPALITIES IN THE COUNTY;

(2) REGULATE, BY ORDINANCE, ALL FIRE AND RESCUE
SERVICES IN THE COUNTY; AND

(3) LEVY SPECIAL DISTRICT PROPERTY TAXES TO PROVIDE
FOR FIRE AND RESCUE SERVICES.

(C) THE DEPARTMENT OF FIRE AND RESCUE SERVICES SHALL:

(1) CONTAIN A PUBLIC SAFETY DIVISION; AND
