4-603. MISREPRESENTATION.
(A) AUTHORIZED PRACTITIONER OF BARBERING.
UNLESS AUTHORIZED UNDER THIS TITLE TO PRACTICE BARBERING, A
PERSON MAY NOT REPRESENT TO THE PUBLIC, BY USE OF A TITLE,
INCLUDING "LICENSED BARBER", "MASTER BARBER", OR "JOURNEY
BARBER", BY DESCRIPTION OF SERVICES, METHODS, OR PROCEDURES, OR
OTHERWISE, THAT THE PERSON IS AUTHORIZED TO PRACTICE BARBERING IN
THE STATE.
(B) AUTHORIZED TEACHER OF BARBERING.
UNLESS AUTHORIZED UNDER THIS TITLE TO TEACH BARBERING, A
PERSON MAY NOT REPRESENT TO THE PUBLIC, BY USE OF A TITLE,
INCLUDING "LICENSED BARBER TEACHER", BY DESCRIPTION OF SERVICES,
METHODS, OR PROCEDURES, OR OTHERWISE, THAT THE PERSON IS
AUTHORIZED TO TEACH BARBERING IN THE STATE.
(C) BARBERSHOP.
UNLESS AN ESTABLISHMENT HOLDS A BARBERSHOP PERMIT UNDER THIS
TITLE, A PERSON MAY NOT REPRESENT TO THE PUBLIC, BY TITLE, BY
DESCRIPTION OF SERVICES, METHODS, OR PROCEDURES, OR OTHERWISE,
THAT THE ESTABLISHMENT IS A BARBERSHOP.
(D) BARBER SCHOOL.
UNLESS AN ESTABLISHMENT HOLDS A SCHOOL PERMIT UNDER THIS
TITLE, A PERSON MAY NOT REPRESENT TO THE PUBLIC, BY TITLE, BY
DESCRIPTION OF SERVICES, METHODS, OR PROCEDURES, OR OTHERWISE,
THAT THE ESTABLISHMENT IS A BARBER SCHOOL.
REVISOR'S NOTE: Subsections (a) through (c) of this section
are standard language added as an inherent, if not
essential, corollary to §§ 4-601 and 4-602(a) of this
subtitle.
Subsection (d) of this section is new language derived
without substantive change from former Art. 56, §
437(a), as that subsection related to unauthorized
representations.
In subsection (d) of this section, the term "barber
school" is substituted for the former reference to "a
school, training or instruction agency for barbers",
for brevity and consistency.
Also in subsection (d) of this section, the former
words "firm, or corporation" are deleted as
unnecessary in light of the definition of "person".
