WILLIAM DONALD SCHAEFER, Governor                      Ch. 59

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 10 - Attorneys at Law and Attorneys in Fact

40.

(w) In Wicomico County, (1) the State's Attorney's annual

salary is [$34,125. Beginning January 5, 1987, the State's

Attorney's annual salary shall be 75] 90 percent of a District
Court judge's annual salary.

(2)  From and after the date of the enactment of this
section, the Wicomico County Council shall pay all expenses for
the conduct of the office of State's Attorney, including but not
limited to clerical and secretarial expenses, telephone charges,
office supplies, postage, premium on official bonds the State's
Attorney deems necessary for the proper conduct of his office,
upon vouchers submitted by the State's Attorney.

(3)  The State's Attorney shall serve full time and
may not engage in the private practice of law.

(4)  The State's Attorney of Wicomico County is
required to maintain and staff an office in the Wicomico County
courthouse.

(5)  The State's Attorney for Wicomico County may
appoint assistant State's Attorneys upon the terms, conditions,
and salaries as are approved by the Wicomico County Council.

(6)  The assistant State's Attorneys shall serve at
the pleasure of the State's Attorney. The assistant State's
Attorneys have the same legal powers as the State's Attorney to
represent the State before grand juries and in the trial of
criminal proceedings.

(7)   In addition, the State's Attorney for Wicomico
County, with the prior approval of the resident judge of the
Circuit Court for Wicomico County, and the Wicomico County
Council, may appoint additional special assistant State's
Attorneys he considers necessary, to serve for a particular case
or series of cases, upon salaries, terms, and conditions to be
set and approved by the Wicomico County Council.

SECTION 2. AND BE IT FURTHER ENACTED, That, pursuant to
Article III, § 35 of the Constitution of Maryland, this Act may
not be construed to extend or apply to the salary or compensation
of the Wicomico County State's Attorney in office on the
effective date of this Act, but the provisions of this Act
concerning the salary or compensation of the Wicomico County
