A SEPARATE BARBERSHOP PERMIT IS REQUIRED FOR EACH BARBERSHOP
THAT A PERSON OPERATES.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 56, § 434,
as it related to obtaining a license.

This section is revised as a duty of the person who
"operate[s]" a barbershop, rather than the "owner" of
the barbershop, for clarity.

The word "permit" is substituted for the former word
"license", to conform to changes in terminology made
throughout this article with regard to other business
occupations. See the General Revisor's Note to this
article.

4-502. QUALIFICATIONS OF APPLICANTS FOR BARBERSHOP PERMITS.

(A)  IN GENERAL.

TO QUALIFY FOR A BARBERSHOP PERMIT, AN APPLICANT SHALL BE A
PERSON WHO MEETS THE REQUIREMENTS OF THIS SECTION.

(B)  OWNERSHIP.

AN APPLICANT SHALL OWN THE BARBERSHOP FOR WHICH THE
APPLICATION IS MADE.

(C)  LOCATION AND EQUIPMENT.

AN APPLICANT SHALL SATISFY THE BOARD THAT THE LOCATION AND
EQUIPMENT OF THE BARBERSHOP FOR WHICH THE APPLICATION IS MADE
MEETS THE REQUIREMENTS OF:

(1)  THE BOARD;

(2)  THE DEPARTMENT OF HEALTH AND MENTAL HYGIENE; AND

(3)  THE APPLICABLE LOCAL ZONING CODE.

(D)  INSPECTION.

AS A CONDITION OF THE ISSUANCE OF A BARBERSHOP PERMIT, THE
BARBERSHOP FOR WHICH THE APPLICATION IS MADE SHALL PASS A
PRE-OPENING INSPECTION CONDUCTED UNDER § 4-522 OF THIS SUBTITLE.
