Also in subsection (a)(1) of this section, the former
authority "to receive not less than 1,200 hours of
theory and practical instruction" is deleted as
misleading. Registration as a student authorizes an
individual to enroll in a barber school and
participate in a training program. While a student
must complete at least 1,200 hours of training to
qualify for a journey barber license, registration
authorizes an individual to be a student, not to
receive a certain number of hours of training.

4-405. DENIALS, REPRIMANDS, SUSPENSIONS, AND REVOCATIONS --
GROUNDS.

SUBJECT TO THE HEARING PROVISIONS OF § 4-406 OF THIS
SUBTITLE, THE BOARD MAY DENY REGISTRATION AS A STUDENT TO ANY
APPLICANT, REPRIMAND ANY INDIVIDUAL REGISTERED AS A STUDENT, OR
SUSPEND OR REVOKE THE REGISTRATION OF ANY INDIVIDUAL:

TITLE;

(1) FOR ANY APPLICABLE GROUND UNDER § 4-316 OF THIS

(2)  IF THE APPLICANT OR INDIVIDUAL FRAUDULENTLY OR
DECEPTIVELY OBTAINS OR ATTEMPTS TO OBTAIN REGISTRATION FOR THE
APPLICANT OR INDIVIDUAL OR FOR ANOTHER; OR

(3)   IF THE APPLICANT OR INDIVIDUAL FRAUDULENTLY OR
DECEPTIVELY USES A CERTIFICATE OF REGISTRATION.

REVISOR'S NOTE: This section is new language added to state
expressly that the Board may take disciplinary action
against a student. Under former Art. 56, § 433, a
barber student held a "permit" and former Art. 56, §
440(a) provided for disciplinary action against "a
licensee or an applicant". Thus, a literal
interpretation of former Art. 56, § 440(a) would not
include students. The Business Occupations Article
Review Committee understands, however, that the former
reference to licensees and applicants was intended to
be interpreted broadly to include any part of
permission that, by law, must be obtained from the
Board, regardless of form, including, e.g., a permit
under the former law -- now a registration. This
interpretation is consistent with the understanding of
the Board and the Department.
