the express inclusion of the power to reprimand a
licensee in § 4-316 of this subtitle, when read with
this section, results in new express requirements that
a hearing be held before the Board may reprimand a
licensee and, consequently, that the review procedures
of § 4-208 of this title be available to the licensee
after a final Board decision to reprimand. This
change is made to conform to other occupational board
provisions found throughout the Code and to meet
fundamental requirements of fairness.

In subsection (d) of this section, the former
reference to "registered" mail is deleted for
consistency. Art. 1, § 20 of the Code provides that
"certified mail" includes "registered mail".

SUBTITLE 4. REGISTRATION OF STUDENTS.

4-401. REGISTRATION REQUIRED.

AN INDIVIDUAL SHALL BE REGISTERED BY THE BOARD BEFORE THE
INDIVIDUAL MAY ENROLL OR PARTICIPATE AS A STUDENT IN A BARBER
SCHOOL IN THE STATE.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first sentence of
former Art. 56, § 433, except for the reference to
fees, and rephrased in language comparable to the
standard language used to state affirmatively that an
individual must be licensed to engage in a regulated
practice.

The reference to being "registered" is substituted for
the former reference to issuance of a "barber school
student's permit" to conform to changes made in
terminology throughout this article. See the General
Revisor's Note to this article.

4-402. APPLICATIONS FOR REGISTRATION.

AN APPLICANT FOR REGISTRATION AS A STUDENT SHALL:

(1)  SUBMIT TO THE BOARD AN APPLICATION ON THE FORM
THAT THE BOARD PROVIDES; AND

(2)  PAY TO THE BOARD AN APPLICATION FEE OF $5.
