AN ACT concerning

Charles County - Drainage Facilities

FOR the purpose of authorizing the Charles County Commissioners
to construct and maintain drainage facilities; authorizing a
certain tax special assessment to be levied to pay for
certain costs of drainage facilities; permitting the
creation of a drainage facilities district under certain
circumstances; permitting a certain tax special assessment
to be levied to pay for certain costs of a drainage
facilities district; and generally relating to drainage
facilities in Charles County.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 9 - Charles County

122-11.

(A) IN ADDITION TO THEIR OTHER POWERS, THE COUNTY
COMMISSIONERS MAY PROVIDE FOR THE CONSTRUCTION AND MAINTENANCE OF
DRAINAGE FACILITIES ALONG ALL OR ANY PART OF THE STREETS, LANES,
ALLEYS, AND PUBLIC WAYS OF THE COUNTY, AND ENTER INTO AGREEMENTS
WITH ANY PERSON, PARTNERSHIP, OR CORPORATION FOR THEIR
CONSTRUCTION AND MAINTENANCE.

(B) THE COSTS OF THE CONSTRUCTION AND MAINTENANCE OF
DRAINAGE FACILITIES PROVIDED UNDER THE AUTHORITY OF THIS SECTION
SHALL BE PAID BY AD VALOREM TAXES A SPECIAL ASSESSMENT LEVIED
UPON THE PROPERTY WITHIN THE AREA TO BE SERVED BY THE
CONSTRUCTION AND MAINTENANCE OF DRAINAGE FACILITIES.
