in another state. This phrase, which is included in
comparable provisions throughout the Code and which
conforms to practice of the Board, allows the Board to
give fair consideration under this section to a barber
who, in the course of a professional career, practices
in several states before moving to this State to
practice.

In subsection (b)(4)(i) and (5) of this section, the
word "certifying" is substituted for the former words
"attesting" and "verifying", for uniformity and
clarity.

The first sentence of former Art. 56, § 438(b), which
required an applicant for a reciprocal master barber
license to pass an examination, is deleted as
unnecessary in light of this section and § 4-302(e) of
this subtitle.

4-308. SAME

APPLICANT LICENSED IN FOREIGN COUNTRY.

(A)  IN GENERAL.

SUBJECT TO THE PROVISIONS OF THIS SECTION, THE BOARD MAY
WAIVE THE WRITTEN PART OF THE MASTER BARBER OR JOURNEY BARBER
EXAMINATION FOR AN INDIVIDUAL WHO IS LICENSED TO PRACTICE
BARBERING IN A FOREIGN COUNTRY.

(B)  CONDITIONS.

SUBJECT TO SUBSECTION (C) OF THIS SECTION, THE BOARD MAY
GRANT A WAIVER UNDER THIS SECTION ONLY IF THE APPLICANT:

(1) PAYS THE APPLICATION FEE REQUIRED UNDER § 4-304
OF THIS SUBTITLE;

(2)  PASSES THE PRACTICAL PART OF THE MASTER BARBER OR
JOURNEY BARBER EXAMINATION GIVEN BY THE BOARD; AND

(3)  PROVIDES ADEQUATE EVIDENCE THAT, AT THE TIME THE
APPLICANT WAS LICENSED IN THE FOREIGN COUNTRY, THE APPLICANT WAS
REQUIRED TO PASS AN EXAMINATION AND MEET QUALIFICATIONS THAT WERE
SUBSTANTIALLY EQUIVALENT TO THOSE THEN REQUIRED BY THE LAWS OF
THIS STATE.

(C) MINIMUM STANDARDS.

TO MEET A MINIMUM STANDARD OF TRAINING, THE BOARD MAY
REQUIRE AN APPLICANT LICENSED TO PRACTICE BARBERING IN A FOREIGN
