(j) "Rental housing production project" or "project" means
any project or undertaking for the acquisition, construction, or
rehabilitation of buildings and improvements, or any portion
thereof, which buildings and improvements or portion thereof will
be occupied by families of lower income as follows:

(1)  For projects which qualify for federal low-income
housing tax credits, the number of residential units selected by
the sponsor to satisfy the federal requirements will be occupied
by families of lower income[,]; or

(2)  For all other projects, all residential units
will be occupied by families of lower income.

The Department shall promulgate such standards for the
eligibility of insurance as are reasonable to provide that the
insurance shall aid in the financing of (1) the purchase,
construction, or rehabilitation as defined in [§ 2-302(e)] §
2-302(O) of this article, of housing; or (.2) energy conservation
projects and solar energy projects. These standards shall also
assure that the mortgagee is responsible and able to service the
mortgage properly.
