(iii) The total circumstances of the case
dictate that seizure and forfeiture is justified; these
circumstances would include such factors as the following:

(a)  The possession of controlled
dangerous substances;

(b)  An extensive criminal record of the
violator;

(c)  A previous conviction of the violator
for a controlled dangerous substances violation;

(d)  Corroborated information is developed
indicating that the violator is or was recently a seller, or
frequently associates with individuals known to be distributors
of illegal controlled dangerous substances or paraphernalia;

(e)  Circumstances of the arrest;

(f)  The manner in which the vehicle was
being used.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1988.

Dear Mr. President:

In accordance with Article II, Section 17 of the Maryland
Constitution, I have today vetoed Senate Bill 473.

Senate Bill 473 regulates how disputes involving construction
contract payments are to be resolved. It requires that when such
disputes occur the undisputed amounts must be paid. In addition,
it exempts five different types of transactions, including State
procurement contracts, from the provisions of the Act.

It is my understanding that this legislation will allow
contractors to bypass the dispute provisions set forth in the
local government's contracting laws, contract provisions, and
regulations. Granting that type of authority to contractors
