include certain restrictions and certain requirements with
respect to certain practices of cytotechnologists,
cytopathologists, and cytology laboratories .; requiring
the Secretary of Health and Mental Hygiene to establish and
conduct a certain testing program; requiring medical
laboratories to pay a certain fee for a certain proficiency
testing program; and generally relating to the regulation of
certain medical laboratories in the State.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

17-215.1.
(A) THE SECRETARY SHALL ADOPT REGULATIONS GOVERNING MEDICAL
LABORATORIES ENGAGED IN THE FIELD OF CYTOPATHOLOGY THAT INCLUDE
THE PROVISIONS OF THIS SECTION. , INCLUDING REGULATIONS THAT:
(1) LIMIT THE NUMBER OF SLIDES A CYTOTECHNOLOGIST MAY
EXAMINE PER DAY;
(2) PROHIBIT CYTOTECHNOLOGISTS FROM EXAMINING SLIDES
AT ANY RESIDENTIAL DOMICILE OR ANY BUILDING NOT OWNED OR USED BY
A LICENSED MEDICAL LABORATORY;
(3) PROHIBIT PAYMENT TO CYTOTECHNOLOGISTS ON A
PIECEWORK BASIS;
(4) REQUIRE CYTOLOGY LABORATORIES TO RESCREEN NO LESS
THAN 10 PERCENT OF ALL NEGATIVE PAP SMEARS;
(5) REQUIRE THAT CYTOLOGY RESCREENING BE PERFORMED BY
A SUPERVISORY LEVEL CYTOTECHNOLOGIST OR A CYTOPATHOLOGIST;
(6) REQUIRE THE PATHOLOGIST WHO DIRECTS THE
CYTOPATHOLOGY LABORATORY TO ESTABLISH AND ADMINISTER AN ONGOING
QUALITY ASSURANCE PROGRAM WITH STANDARDS RECOGNIZED BY
PROFESSIONAL ORGANIZATIONS;
(7) REQUIRE CYTOLOGY LABORATORIES TO REJECT
IMPROPERLY PREPARED SPECIMENS, MAKE APPROPRIATE COMMENTS
REGARDING THE QUALITY OF THE SPECIMEN, AND MAINTAIN RECORDS ON
