Cost Review Commission - Funding -
Sunset Provision
FOR the purpose of repealing a certain termination date
concerning funding for the Health Resources Planning
Commission and the Health Services Cost Review Commission;
altering the date on which the Health Services Cost Review
Commission and the Health Resources Planning Commission must
have assessed user fees on certain facilities each year;
altering the date by which certain facilities must have
payment of assessed user fees to the Health Services Cost
Review Commission and the Health Resources Planning
Commission; and providing for a certain effective date.

Chapter 684 of the Acts of the General Assembly of 1986

Preamble
WHEREAS, Sections 19-122 and 19-207.1 of the Health -
General Article which requires the Health Resources Planning
Commission and Health Services Cost Review Commission
respectively, to assess and collect user fees on certain
facilities within their jurisdiction automatically terminates on
June 30, 1988; and
WHEREAS, Unless the sunset provision, Section 3 of Chapter
684 of the Laws of 1986, is removed, the previous authorization
which provides that the amount of the user fee collections be
capped at $1,000,000 annually automatically will take effect
after June 30, 1988; and
WHEREAS, This reversion is a move backward because the
Commissions Health Resources Planning Commission billed the
industry approximately $1,271,742 in Fiscal Year 1987 and
$1,131,795 in Fiscal Year 1988, due to the decrease in General
Fund appropriation. Moreover, the estimated anticipated billing
for Fiscal Year 1988 is $1,131,795, due to the decrease in
General Fund appropriation by the Health Services Cost Review
Commission in Fiscal Year 1989 will be in the excess of the
$1,000,000 level, as well; now, therefore; ,
