SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 78 - Public Service Commission Law

(o) "Public service company" means a common carrier
company, gas company, electric company, steam heating company,
telephone company, telegraph company, [radio common carrier,]
water company, sewage disposal company, and/or any combination
thereof. Two public service companies shall be considered of the
same class, where they are both common carrier companies or both
gas companies, electric companies, gas and electric companies,
steam heating companies, telephone companies, telegraph
companies, water companies, OR sewage disposal companies [or
radio common carriers].

(z) "Telephone company" includes any public service company
which owns telephone lines for the reception, transmission or
communication of messages by telephone or teletype, or which
lets, licenses, or sells telephonic or teletype communication. IT
DOES NOT INCLUDE A CELLULAR TELEPHONE COMPANY.

[55A.

(a) No radio common carrier shall begin or continue the
construction or operation of any radio common carrier system or
any extension thereof,, either directly or indirectly, without
first obtaining from the Commission a certificate that the public
convenience and necessity required such construction, operation
or extension. However, this article shall not require nor shall
it be so construed to require any carrier to secure a certificate
for any of the following:

(1) An extension within any authorized service area
within which the carrier has heretofore lawfully commenced
operations, (2) any extension within or to territory already
served by the carrier, necessary in the ordinary course of
business, (3) substitute facilities within or to any authorized
