Ch. 735

LAWS OF MARYLAND

(II)  THE TAX REVENUES SHALL BE DEPOSITED AND
MAINTAINED IN A SEPARATE STORMWATER MANAGEMENT FUND; AND

(III)  THE TAX REVENUES DEPOSITED IN THE FUND
SHALL BE IN ADDITION TO ALL OTHER COUNTY TAXES AND MAY NOT BE
CONSIDERED COUNTY TAXES. FOR THE PURPOSE OF APPLYING THE
LIMITATIONS IN ARTICLE VIII, SECTION 817B OF THE PRINCE GEORGE'S
COUNTY CHARTER.

(C)  PROPERTY OWNED BY THE STATE OR AN AGENCY OF THE STATE,
A COUNTY, A MUNICIPALITY, OR A REGULARLY ORGANIZED VOLUNTEER FIRE
DEPARTMENT THAT IS USED FOR PUBLIC PURPOSES SHALL BE EXEMPT FROM
THE TAX IMPOSED UNDER THIS SECTION.

(D)  PROPERTY WHICH IS NOT YET WITHIN A STORMWATER
MANAGEMENT AREA OR IS NOT YET OTHERWISE PROVIDED DIRECT OR
INDIRECT STORMWATER MANAGEMENT SERVICES IN THE STORMWATER
MANAGEMENT DISTRICT MAY NOT HAVE THE TAX IMPOSED UNTIL THE COUNTY
ACQUIRES, EXTENDS, OR COMMENCES THE STORMWATER MANAGEMENT
SERVICES, FACILITIES, OR PROGRAMS TO THE PROPERTY.

SECTION 2. AND BE IT FURTHER ENACTED, That when and to the
extent that the Washington Suburban Sanitary Commission becomes
responsible, under Chapter 685 of the 1987 Maryland Laws or any
later Act of the General Assembly of Maryland, for stormwater
management or surface water drainage within Prince George's
County or that portion of Takoma Park within Montgomery County,
the counties shall transfer, assign, and convey to the WSSC all
tangible and intangible real and personal property which the
counties and the WSSC mutually determine is necessary for the
full exercise of that responsibility, except that each county
shall retain sufficient funds to pay for: (1) payments of
principal, interest, and related costs accruing prior to October
1, 1990 on outstanding bonds issued by that county for stormwater
management; (2) the undepreciated costs of the movable assets
transferred; and (3) any contracts, agreements, programs, or
projects which the WSSC and the respective county jointly
determine should be completed by that county. The WSSC shall
assume all other contracts, agreements, claims, demands, and
actions relating to or payable from the property transferred to
the WSSC. The WSSC may enter into contracts or agreements with
either county for the continued provision of stormwater
management programs.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1988.
