Ch. 647
LAWS OF MARYLAND
"Provide plumbing services" § 3-101
3-603. SAME — WILLFUL VIOLATION.
EXCEPT AS OTHERWISE PROVIDED IN THIS TITLE, REGARDLESS OF
WHETHER A PERSON IS ENGAGED IN THE BUSINESS OF PROVIDING PLUMBING
SERVICES, THE PERSON MAY NOT KNOWINGLY EMPLOY AN INDIVIDUAL TO
PROVIDE OR ASSIST IN PROVIDING PLUMBING SERVICES IN THE STATE
UNLESS THE INDIVIDUAL IS LICENSED BY THE BOARD.
COMMITTEE COMMENT: This section is new language that
combines the second and third sentences of former Art.
56, § 446, except for the penalty provisions.
The former sentences provided, respectively, for a
person "engaged in the plumbing business, [or] the
superintendent ... or other officer of any corporation
engaged in the plumbing business" and for a person or
officer of a corporation "not engaged in the plumbing
business". Accordingly, the phrase "regardless of
whether a person is engaged in the business ..." is
substituted for the former enumerations of persons.
As to the referenced exceptions, see §§ 3-103, 3-104,
and 3-301 of this title.
Defined terms: "Board" § 3-101
"Person" § 1-101
"Provide plumbing services" § 3-101
3-604. MISREPRESENTATION.
UNLESS AUTHORIZED TO PROVIDE PLUMBING SERVICES UNDER THIS
TITLE, A PERSON MAY NOT REPRESENT TO THE PUBLIC BY USE OF THE
TITLES "MASTER PLUMBER", "REGISTERED PLUMBER", "LICENSED MASTER
PLUMBER", "HOLDER OF LIMITED MASTER PLUMBER LICENSE", "LICENSED
JOURNEY PLUMBER", "JOURNEY PLUMBER", OR "HOLDER OF A LIMITED
JOURNEY PLUMBER LICENSE", BY OTHER TITLE, OR BY DESCRIPTION OF
SERVICES, METHODS, OR PROCEDURES, OR OTHERWISE, THAT THE PERSON
IS AUTHORIZED TO PROVIDE PLUMBING SERVICES IN THE STATE.
COMMITTEE COMMENT: This section is new language substituted
for the first and second clauses of the first sentence
of former Art. 56, § 448, which restricted only the
use of the terms "master plumber" and "registered
plumber".
See also Title 14 of the Commercial Law Article, for
other consumer protection provisions.
