3-602. EMPLOYMENT OF UNAUTHORIZED INDIVIDUAL IN PLUMBING WORK —
IN GENERAL.

EXCEPT AS OTHERWISE PROVIDED IN THIS TITLE, A MASTER
PLUMBER, HOLDER OF A LIMITED MASTER PLUMBER LICENSE, OR OTHER
PERSON WHO ENGAGES IN THE BUSINESS OF PROVIDING PLUMBING SERVICES
MAY NOT EMPLOY AN INDIVIDUAL TO PROVIDE OR ASSIST IN PROVIDING
PLUMBING SERVICES UNLESS THE INDIVIDUAL:

(1)  IS LICENSED BY THE BOARD AS A MASTER PLUMBER OR
HOLDER OF A LIMITED MASTER PLUMBER LICENSE; OR

(2)  (I) IS LICENSED BY THE BOARD AS A JOURNEY
PLUMBER, HOLDER OF A LIMITED JOURNEY PLUMBER LICENSE, OR
APPRENTICE PLUMBER; AND

(II) PROVIDES OR ASSISTS IN PROVIDING THE
PLUMBING SERVICES WITHIN THE SCOPE OF THE LICENSE.

COMMITTEE COMMENT: The introductory language of this
section is new language derived from the first clause
of the first sentence of former Art. 56, § 446.

Items (1) and (2) of this section are new language
substituted for the second clause of the first
sentence of former Art. 56, § 446, which merely
referred to "those qualified to work at the plumbing
business, as provided in this subtitle of this
article", for clarity.

In the introductory language of this section, the
reference to "holder of a limited master plumber
license" is added in conformity with the provisions
throughout this title that apply to holders of limited
master plumber licenses. See the General Committee
Comment to this title.

Also in the introductory language of this   section, the

limitation "who engages in the business   of providing

plumbing services" is added for clarity     since other

persons are covered under § 3-603 of this   subtitle.

The former words "firm" and "corporation" are deleted
as unnecessary in light of the defined term "person",
which includes firm and corporation.

As to the referenced exceptions, see §§ 3-103, 3-104,
and 3-301 of this title.
