1. PASSED AN EXAMINATION THAT WAS GIVEN
BY BALTIMORE COUNTY OR THE WASHINGTON SUBURBAN SANITARY
COMMISSION AND WAS SUBSTANTIALLY EQUIVALENT TO THE EXAMINATION
THAT THEN WAS REQUIRED BY THE BOARD; AND
2. MET QUALIFICATIONS FOR LICENSING THAT
WERE SET BY BALTIMORE COUNTY OR THE WASHINGTON SUBURBAN SANITARY
COMMISSION AND WERE SUBSTANTIALLY EQUIVALENT TO THE
QUALIFICATIONS THAT THEN WERE REQUIRED BY THE BOARD.
(C) RECIPROCITY.
(1) SUBJECT TO PARAGRAPH (2) OF THIS SUBSECTION, THE
BOARD MAY GRANT A WAIVER OF THE QUALIFICATION AND EXAMINATION
REQUIREMENTS OF § 3-302 OF THIS SUBTITLE ONLY IF BALTIMORE COUNTY
OR THE WASHINGTON SUBURBAN SANITARY COMMISSION WAIVES THE
QUALIFICATIONS AND EXAMINATION REQUIRED FOR INDIVIDUALS LICENSED
BY THE BOARD TO A SIMILAR EXTENT AS THE BOARD WAIVES THOSE
REQUIREMENTS FOR INDIVIDUALS LICENSED BY BALTIMORE COUNTY OR THE
WASHINGTON SUBURBAN SANITARY COMMISSION.
(2) AN AGREEMENT MAY BE MADE WITH BALTIMORE COUNTY
THAT, IF AN INDIVIDUAL WHO IS LICENSED BY THE BOARD AS A JOURNEY
PLUMBER OR A MASTER PLUMBER RESIDES IN BALTIMORE COUNTY, THE
INDIVIDUAL MAY BE REQUIRED TO PASS A LICENSING EXAMINATION FOR A
JOURNEY PLUMBER OR MASTER PLUMBER GIVEN BY BALTIMORE COUNTY.
COMMITTEE COMMENT: Subsections (a), (b)(1), (2), and (4),
and (c)(1) of this section are new language derived
from former Art. 56, § 453(f), except the requirement
for deposit of a bond. While, on its face, former §
453(f) seemed to apply only to an applicant for a
master plumber license, the Board has interpreted §
453(f) to apply to both a journey plumber license and
a master plumber license. Accordingly, this section
is rephrased to apply to both.
Subsection (b)(3) of this section is new language
substituted for the requirement, in former Art. 56, §
453(f), that the applicant "deposit ... the bond
required by the Board". Former Art. 56, § 462C — now
§ 3-501 of this title — established insurance
requirements in lieu of former bond requirements.
Subsection (c)(2) of this section is new language
added to reflect a recognized agreement entered into
by the Board and Baltimore County in 1978 to allow
Baltimore County to require any applicant who resides
in Baltimore County and applies for a journey plumber
license or a master plumber license from the Baltimore
County Plumbing Board to pass an examination given by
the Baltimore County Plumbing Board.
