COMMITTEE COMMENT: This section is new language added to
state expressly the purposes of this title.

3-103. SCOPE OF TITLE — COUNTIES.

(A)  BALTIMORE COUNTY.

EXCEPT AS EXPRESSLY PROVIDED IN § 3-305 OF THIS TITLE, THIS
TITLE DOES NOT APPLY TO BALTIMORE COUNTY.

(B)  WASHINGTON SUBURBAN SANITARY COMMISSION.

EXCEPT AS EXPRESSLY PROVIDED IN § 3-305 OF THIS TITLE, THIS
TITLE DOES NOT APPLY TO AREAS OF ANNE ARUNDEL, HOWARD,
MONTGOMERY , AND PRINCE GEORGE'S COUNTIES THAT ARE UNDER THE
JURISDICTION OF THE WASHINGTON SUBURBAN SANITARY COMMISSION.

COMMITTEE COMMENT: This section is new language derived
from the first sentences of §§ 455 and 456.

In subsection (b) of this section, the reference to
"areas of Montgomery and Prince George's Counties that
are under the jurisdiction of the Washington Suburban
Sanitary Commission" is substituted for the former
reference to "Montgomery and Prince George's
counties", to clarify that the scope exemption under
this subsection conforms exactly to the areas under
the jurisdiction of the WSSC. Accordingly,
subdivisions not under the WSSC, such as Poolesville
and Rockville in Montgomery County and Bowie in Prince
George's County, are within the scope of this title.

As to the deletion or transfer of the rest of those
former sections, see the General Committee Comment to
this title.

3-104. SAME — EXEMPT INDIVIDUALS.

THIS TITLE DOES NOT LIMIT THE RIGHT OF AN INDIVIDUAL TO
PRACTICE WELL DRILLING IF THE INDIVIDUAL IS LICENSED OR OTHERWISE
AUTHORIZED TO PRACTICE WELL DRILLING UNDER TITLE 13 OF THE
ENVIRONMENT ARTICLE.

COMMITTEE COMMENT: This section is new language substituted
for the third sentence of former Art. 56, § 448, which
apparently exempted well drillers from the prohibition
against misrepresentation as a master plumber. The
substituted language clarifies the intent of the
former sentence — i.e., to allow licensed well
drillers to practice any authorized well drilling
activity without first acquiring a master plumber
license.
