4-610. FILING FALSE STATEMENT REGARDING GUARANTY FUND.

A PERSON MAY NOT FILE WITH THE COMMISSION ANY NOTICE,
STATEMENT, OR OTHER DOCUMENT UNDER SUBTITLE 4 ["REAL ESTATE
GUARANTY FUND"] OF THIS TITLE THAT A PERSON KNOWS TO BE FALSE OR
TO CONTAIN ANY MATERIAL MISSTATEMENT OF FACT.

SUBCOMMITTEE COMMENT: This section is new language
substituted for former Art. 56, § 217A(g), which
provided that a person filing a false statement with
the Commission in a claim against the Guaranty Fund
shall be fined $200. Under the former language it was
unclear whether a violation of the provision was
intended to constitute a criminal offense or merely a
civil offense that was subject to a fine. The new
language of this section reflects the determination by
the Joint Subcommittee on the Business Occupations
Article that the former provision should be
interpreted as a criminal provision. The new language
also makes it clear that this prohibition applies
regardless of whether the statement involved was
"required" or it was filed gratuitously.

4-613 of this subtitle.

4-611. VIOLATION OF SUSPENSION ORDER — REAL ESTATE CONSERVATION
AREAS.

A PERSON MAY NOT VIOLATE A SUSPENSION ORDER ISSUED UNDER §
4-522 ["REAL ESTATE CONSERVATION AREAS"] OF THIS TITLE.

SUBCOMMITTEE COMMENT: This section is new language derived
without substantive change from the first clause of
former Art. 56, § 230C(f). It is restated as an
affirmative prohibition.
