WILLIAM DONALD SCHAEFER, Governor

Ch. 563

4-521. DISHONORED CHECKS.

(A)  ADDITIONAL FEE.

IF A PERSON TENDERS A CHECK TO THE COMMISSION IN PAYMENT OF
A FEE AND THE CHECK IS DISHONORED, THE PERSON SHALL PAY TO THE
COMMISSION AN ADDITIONAL FEE FOR COST OF COLLECTION OF $20 $25
FOR EACH DISHONORED CHECK.

(B)  FULL PAYMENT REQUIRED.

IF A PERSON IS CHARGED AN ADDITIONAL FEE UNDER THIS SECTION
BY THE COMMISSION, THE ORIGINAL FEE MAY NOT BE CONSIDERED PAID
UNTIL BOTH THE ORIGINAL FEE AND THE ADDITIONAL FEE ARE PAID IN
FULL.

SUBCOMMITTEE COMMENT: Subsection (a) of this section is new
language derived in part without substantive change
from former Art. 56, § 223(1) and the introductory
language of that section. The fee is raised to $25,
to cover increases in the cost of collection. In
addition, this item has been revised, on the
recommendation of the Joint Subcommittee on the
Business Occupations Article, to establish a uniform
fee for tendering a dishonored check for residents and
nonresidents in conformity with changes in the fee
structure made throughout this title. See the General
Subcommittee Comment to this title.

Subsection (b) of this section is new language added
to clarify that the original fee is not considered
paid until the additional fee is paid.

In subsection (a) of this section, the phrase "for
each dishonored check" is added to clarify that each
instance of a dishonored check required an additional
fee.

Defined terms: "Commission" § 4-101
"Person" § 1-101

4-522. REAL ESTATE CONSERVATION AREAS.

(A)  IN GENERAL.

AFTER A PUBLIC HEARING, THE COMMISSION MAY DECLARE AN URBAN
AREA A "REAL ESTATE CONSERVATION AREA" IF THE COMMISSION FINDS
THAT THE RACIAL STABILITY OF THE AREA IS THREATENED BY THE VOLUME
OF REAL ESTATE TRANSACTIONS.

(B)  SUSPENSION OF ADVERTISING AND SOLICITATION.
