real estate broker or a real estate salesperson or
otherwise authorized to provide real estate brokerage
services. In addition language is added to clarify
that a licensee must either be the broker of the firm
or a licensee who is licensed to provide real estate
brokerage services for and continues to be affiliated
with the broker of the firm.

Subsection (e) of this section is new language added
to clarify the responsibility of an individual who
serves as the broker of a firm.

Subsection (f) of this section is new language added
to clarify the liability of corporations and
partnerships that provide real estate brokerage
services and individuals who provide real estate
brokerage services through a corporation or
partnership.

In subsection (b)(1) of this section, which lists the
requirements for a real estate broker to qualify to
provide real estate brokerage services through a
corporate or partnership firm, the language "shall be
employed by or have another contractual relationship
with the corporation or partnership" is substituted
for the former language "shall designate one of its
members or one of its officers", to conform to current
practice in the industry.

The second clause of the first sentence of former Art.
56, § 218(b), which provided for the limited scope of
a license issued to a "member or officer of a
partnership, association, or copartnership" is deleted
as misleading. The acts that can be rendered under a
real estate salesperson or an associate real estate
broker license are limited to real estate brokerage
services provided on behalf of the real estate broker
with whom the salesperson or associate broker is
affiliated, and have nothing to do with one's status
as a "member or officer".
