LICENSE OF A DECEASED REAL ESTATE BROKER IS RESPONSIBLE FOR
RENEWING THE LICENSE AS REQUIRED UNDER § 4-314 OF THIS SUBTITLE.
(3) IF AN INDIVIDUAL WHO HAS BEEN REISSUED THE
LICENSE OF A DECEASED REAL ESTATE BROKER DOES NOT MEET THE
EDUCATIONAL REQUIREMENTS FOR A REAL ESTATE BROKER LICENSE WITHIN
THE 4-YEAR PERIOD, THE LICENSE SHALL EXPIRE AUTOMATICALLY AT THE
END OF THAT PERIOD.
(4) IF AN INDIVIDUAL WHO HAS BEEN REISSUED THE
LICENSE OF A DECEASED REAL ESTATE BROKER MEETS THE EDUCATION
EDUCATIONAL REQUIREMENTS FOR A REAL ESTATE BROKER LICENSE WITHIN
THE 4-YEAR PERIOD, THE INDIVIDUAL MAY CONTINUE TO HOLD THE
LICENSE AND MAY RENEW THE LICENSE UNDER § 4-314 OF THIS SUBTITLE.
SUBCOMMITTEE COMMENT: Subsection (a) of this section is new
language derived in part without substantive change
from the fifth sentence of former Art. 56, §
217(c)(1). New language is added, on the
recommendation of the Joint Subcommittee on the
Business Occupations Article, to limit the period that
a family member may carry on the business to 6 months
and to limit the scope of carrying on the business to
closing and terminating the business.
Subsection (b) of this section is new language added
to provide a mechanism for a family member of a
deceased real estate broker to qualify to carry on the
business of the deceased broker. The provisions of
this subsection conform to the current practice of the
Commission.
Subsection (c) of this section is new language added
to state expressly that the Commission shall reissue
the license of a deceased real estate broker for a
term of 6 months to a family member who qualifies to
carry on the business of the deceased broker.
Subsection (d) of this section is new language derived
without substantive change from the sixth sentence of
former Art. 56, § 217(c)(1).
Subsection (e) of this section is new language added
to state expressly that the Commission shall reissue
the license of a deceased real estate broker to an
individual who qualifies for the license.
Subsection (f) of this section is new language derived
without substantive change from the seventh and eighth
sentences of former Art. 56, § 217(c)(1).
In subsection (d) of this section, the former,
specific reference to the date after which an
