SUBCOMMITTEE COMMENT: Subsection (a) of this section is new
language derived without substantive change from the
second clause of the first sentence of former Art. 56,
§ 222(a).
Subsection (b) of this section is new language
substituted, on the recommendation of the Joint
Subcommittee on the Business Occupations Article, for
former Art. 56, § 223(h) and the introductory language
of that section. The new language increases the fee
for issuing a new license certificate when a license
certificate has been lost or destroyed to $5 for
consistency with the fee for issuing a new license
certificate when a licensee or firm has changed its
name. In addition, this subsection is revised to
establish a uniform fee for issuance of a duplicate
license certificate for resident and nonresident
licensees in conformity with changes in the fee
structure made throughout this title. See the General
Subcommittee Comment to this title.
Subsection (c) of this section is new language derived
in part without substantive change from former Art.
56, § 223(j) and the introductory language of that
section. This subsection is revised, on the
recommendation of the Joint Subcommittee on the
Business Occupations Article, to establish a uniform
fee for issuance of a duplicate pocket card for
resident and nonresident licensees in conformity with
changes in the fee structure made throughout this
title. See the General Subcommittee Comment to this
title.
In subsection (a)(2) of this section, new language is
added to clarify that the license certificate of an
associate broker or salesperson who is affiliated with
a broker must be displayed in the office or branch
office of the broker out of which the associate broker
or salesperson primarily works. This conforms to
present practice in the industry.
In subsection (b)(1) of this section, new language is
added to state expressly that which was only implied
in the former law — i.e., that, if a license
certificate is lost or destroyed, the licensee
immediately shall notify the Commission.
In subsection (b)(2) of this section, new language is
added to state expressly that which was only implied
in the former law — i.e., that a licensee whose
license certificate has been lost or destroyed must
submit an affidavit and fee to the Commission to have
a duplicate license certificate issued.
