Item (9) of this section is new language derived
without substantive change from former Art. 56, § 220.

In item (8) of this section, the term "professional
competence" is substituted for the former term
"competency", to clarify the type of competency
required.

Also in item (8) of this section, the phrase "good
character and reputation" is standard language
substituted for the former phrase "honesty,
truthfulness, integrity", to conform to similar
provisions in other titles of the proposed Business
Occupations Article.

The requirement, in former Art. 56, § 221(a), for
"evidence of their intention to engage actively in
business as a real estate broker" is deleted as a
vague and unworkable standard.

4-308. WAIVER OF REQUIREMENTS.

(A)  IN GENERAL.

SUBJECT TO THE PROVISIONS OF THIS SECTION, THE COMMISSION
MAY WAIVE ANY REQUIREMENT OF THIS SUBTITLE FOR A PARTICULAR
LICENSE FOR AN APPLICANT WHO HOLDS A COMPARABLE OR EQUIVALENT
LICENSE GRANTED BY ANOTHER STATE.

(B)  CONDITIONS.

THE COMMISSION MAY GRANT A WAIVER UNDER THIS SECTION ONLY IF
THE APPLICANT:

(1)  PAYS THE APPLICATION FEE REQUIRED UNDER § 4-307
OF THIS SUBTITLE FOR THE LICENSE FOR WHICH THE APPLICANT IS
APPLYING;

(2)  PROVIDES ADEQUATE EVIDENCE THAT THE APPLICANT
MEETS THE QUALIFICATIONS OTHERWISE REQUIRED BY THIS SUBTITLE FOR
THE LICENSE FOR WHICH THE APPLICANT IS APPLYING;
