The provisions of former Art. 56, § 214(f) that
provided for the inclusion of the positions of all
other Commission employees in the Classified Service
and the exclusion of the positions of Commission
members from the Classified Service are deleted as
superfluous.

4-206. STAFF.

(A)  IN GENERAL.

THE COMMISSION MAY EMPLOY A STAFF IN ACCORDANCE WITH THE
STATE BUDGET.

(B)  INVESTIGATIVE STAFF.

THE COMMISSION, IN ACCORDANCE WITH THE STATE BUDGET, MAY
EMPLOY AN INVESTIGATIVE STAFF TO CONDUCT INVESTIGATIONS.

(C)  EMPLOYMENT RESTRICTIONS.

WHILE EMPLOYED BY THE COMMISSION, AN INDIVIDUAL MAY NOT:

(1)  BE LICENSED IN ANY STATE AS A REAL ESTATE BROKER,
AN ASSOCIATE REAL ESTATE BROKER, OR A REAL ESTATE SALESPERSON;

(2)  ENGAGE IN ANY ACT FOR WHICH A LICENSE IS REQUIRED
UNDER THIS TITLE; OR

(3)  IN CONNECTION WITH ANY REAL ESTATE TRANSACTION,
DIRECTLY OR INDIRECTLY RECEIVE OR BECOME ENTITLED TO RECEIVE ANY
FEE, PERQUISITE, OR COMPENSATION.

SUBCOMMITTEE COMMENT: This section is new language derived
without substantive change from the first sentence of
former Art. 56, § 214(a), as it related to employing
assistants, the first sentence of (d), and (e), except
as it related to the executive director.

Subsections (a) and (b) of this section are rephrased
in standard language used to describe employing a
staff.

In subsection (b) of this section, the term
"investigative staff" is substituted for the former
term "field inspectors", for clarity, since, in fact,
